Terms of Service
Last updated Nov 3, 2026 · MaitreDesk is operated by Stratton Digital LLC (New York).
These Terms of Service ("Terms") govern your use of MaitreDesk (the "Service"), including the website at https://maitredesk.com, the customer dashboard, the website chat widget, and SMS and email messaging features. The Service is operated by Stratton Digital LLC, a New York limited liability company based in New York ("we", "us"). By creating an account, starting a trial, or using the Service, you agree to these Terms on behalf of yourself and the business you represent ("Customer", "you").
1. The Service
MaitreDesk is an AI receptionist for local businesses. It drafts and, where you enable it, sends replies to customer questions received through website chat, text message, and email, using an answer sheet that you approve. You are responsible for the accuracy of the information you provide, for reviewing drafts, and for the replies you approve or configure to send automatically.
2. Accounts
You must provide accurate account information and keep your login secure. You are responsible for activity under your account and for the staff you invite. You must be at least 18 and authorized to bind your business.
3. Free trial
Each plan starts with a 14-day free trial, limited to one trial per business. Nothing is charged at signup. If you do not cancel before the trial ends, your subscription starts and the payment method on file is charged the plan price for the billing period you selected, plus any setup fee. If you cancel during the trial, you are not charged anything, including the setup fee.
4. Subscriptions, billing and taxes
Paid plans are billed in advance on a monthly basis (Starter $149, Growth $299, Pro $549) or an annual basis (Starter $1,490, Growth $2,990, Pro $5,490, equal to 2 months free). Each plan has a one-time setup fee (Starter $300, Growth $500, Pro $900). The setup fee is charged on the first invoice after your free trial, not at signup, and is not charged if you cancel during the trial. Setup fees are one-time and non-refundable. As a founding-customer offer, the setup fee is waived for our first 10 paying customers; the waiver has no cash value. Subscriptions renew automatically at the end of each billing period until cancelled. Payments are processed by Stripe; you authorize us and Stripe to charge your payment method for all fees and applicable taxes. All prices are listed exclusive of applicable sales taxes; any applicable sales tax is calculated and added at checkout based on your location. We may change prices with at least 30 days' notice, effective at your next renewal. Unpaid accounts may be suspended.
4.1 Plan changes
Plan changes are prorated. If you upgrade, you are charged the prorated difference for the rest of the current billing period immediately. If you downgrade, the unused portion of your current plan is credited to future invoices and is not refunded in cash. If you change plans during your free trial, the trial keeps running and nothing is charged until it ends.
5. Cancellation and refunds
You can cancel at any time from the billing portal in your dashboard or by emailing danny.strattondigital@gmail.com. Cancellation takes effect at the end of the current billing period, and you keep access until then. We do not provide refunds or credits for partial billing periods, unused time, or setup fees once charged, except where required by law. See our Refund and Cancellation Policy.
6. Acceptable use
You agree not to use the Service to send spam or unsolicited messages; to message anyone without the consent required by law (including the TCPA, CAN-SPAM, and carrier rules for A2P messaging); to send unlawful, deceptive, harassing, or infringing content; to process sensitive health or payment card data through chat or SMS; or to interfere with, reverse engineer, or overload the Service. We may suspend accounts that violate this section.
7. Messaging compliance
You are responsible for obtaining and documenting consent from people you message through the Service and for honoring opt-out requests. Recipients can reply STOP to opt out of text messages and HELP for help. See the SMS Terms in our Privacy Policy.
8. AI-generated content
Replies are generated with artificial intelligence and may be inaccurate or incomplete. The Service is designed to answer only from your approved answer sheet and to route uncertain or sensitive questions to staff, but you remain responsible for messages sent on your behalf. Do not rely on the Service for emergency, medical, legal, or financial advice.
9. Your data
You own the content you and your customers submit ("Customer Data"). You grant us a limited license to host, process, and transmit Customer Data to provide and improve the Service, as described in our Privacy Policy. We do not sell Customer Data.
10. Third-party services
The Service relies on third-party providers, including Twilio (SMS), Resend (email), Clerk (authentication), Stripe (payments), Vercel (hosting and AI Gateway), and Neon (database). Their availability and terms may affect the Service.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE OR THAT MESSAGES WILL BE DELIVERED.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE, OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.
13. Indemnity
You will defend and indemnify us against claims arising from your Customer Data, your messages, or your violation of these Terms or applicable law.
14. Termination
You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms or non-payment. On termination you may request an export of your Customer Data within 30 days, after which we may delete it.
15. Governing law
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in New York, and both parties consent to that jurisdiction.
16. Changes
We may update these Terms. Material changes will be posted here with a new "Last updated" date and, for active customers, notified by email. Continued use after changes take effect means you accept them.
